ENTITLED

An Ordinance to consolidate and amend the law providing for the grant of pensions to the widows and orphans of deceased public officers.

WHEREAS it is expedient to consolidate and amend the law providing for the granting of pensions to the widows and orphans of deceased public officers of this Colony: Be it therefore enacted by the Governor of Hongkong, with the advice and consent of the Legislative Council thereof, as follows:-

1. This Ordinance may be cited as "The Widows' and Orphans' Pension Fund Ordinance, 1898.”

2. The following words and expressions when used in this Ordinance shall have the meanings hereby assigned to them, unless there is something in the subject or context repugnant to such construction:

“Public officer” shall mean and includes-

(1.) Any person who at the time of the passing of this Ordinance is holding or has held any office in the public service of this Colony, and is contributing to the fund established under the provisions of the Ordinance No 30 of 1890.

(2.) Any person who at the said time is holding or who shall hereafter hold any permanent office in the service of this Colony which is separately provided for on the Estimates and who draws a salary from the Colonial Treasurer of two hundred and forty dollars per annum or upwards, either in respect of one or of two or more such offices held permanently and conjointly; and

(3.) Any person who, having been a "public officer" as aforesaid, is in receipt of a pension from the Government of this Colony in respect of his services as such.

(4.) Any person who may be admitted to the privileges of the fund under section #.

“Salary” shall mean the remuneration paid to a public officer in respect of any permanent office held by him in the service of this Colony in respect of which he may become entitled, under any regulations which are now or which may hereafter be in force, to a pension, but shall not include any fees accruing in respect of such office.

“Treasurer” shall mean the officer holding the office of Treasurer of the Colony.

“Crown Agents” shall mean the Crown Agents for the Colonies in London.

“Directors” shall mean the directors of the fund, appointed under this Ordinance.

“Orphan” shall mean the child of a deceased public officer by his wife, born after marriage.

“Pension” shall mean any pension granted under this Ordinance, except where the context shall imply that the pension of the contributor himself is referred to.

“Pensioner” shall mean any person entitled to a pension under this Ordinance, except where the context implies otherwise.

“The Fund” shall mean all money raised under this Ordinance whether by contributions, fines, interest, loan, or otherwise.

“Widow” shall mean the wife of a deceased public officer.

“Wife” shall mean the lawful wife of any public officer of the Christian or Jewish religion, or in the case of Chinese the Kit Fat, or in the case of any other Asiatic nation the principal wife.

3. The fund shall be called "The Widows and Orphans' Fund," and shall be raised as hereinafter directed.

The directors may admit any public officer who shall have been appointed before the coming into force of Ordinance No. 40 of 1890 to contribute towards the fund, provided that such public officer shall pay forthwith, or by such instalments as the directors shall determine, a sum equal to all the abutements which would have been made from his salary and all the compound interest at the rate of six per cent. which would have accrued on such abutements if he had commenced to contribute to such fund on the date when the said Ordinance first came into force.
